Dear Arizona HSLDA Members and Friends,

During the Tuesday, November 5 hearing about the UN Convention on the Rights of Persons with Disabilities (UNCRPD) in the Senate Foreign Relations Committee, your Senator Jeff Flake was a true leader. As a member of the committee, Senator Flake asked probing, well-thought-out questions to the witnesses.

You may watch Senator Flake’s five minutes of questions to the witnesses 1 hour, 55 minutes, and 30 seconds into the hearing online.

He focused on a case before the U.S. Supreme Court, Bond v. United States. This fascinating case deals with whether ratified treaties expand the power of the federal government beyond its constitutional boundaries. Senator Flake was very worried about the ramifications of this case, and asked each witness in turn if they could guarantee him that ratifying the UNCRPD would not lead to other federal overreaches. Not a single witness could make this guarantee, so Senator Flake urged that the Senate wait on ratifying the UNCRPD until the Supreme Court issued an opinion in the Bond case.

Senators on the committee who support the UNCRPD were so worried about Senator Flake’s question that they spent some time trying to respond to him directly.

HSLDA strongly agrees with Senator Flake that it is deeply irresponsible for the U.S. Senate to consider ratifying a treaty when we do not even know how the Supreme Court will rule in such an important case that goes to the heart of the treaty power.

Please take a moment to call and email Senator Flake and thank him for attending the hearing and for asking important questions. Please also encourage him to vote against this dangerous United Nations treaty when it comes up for a vote in the committee.
