State v. Mr. & Mrs. W
Prosecution threatened for alleged prior lack of compliance with home school requirements

Filed: August 31, 2001, Medina County.

Nature of Case: The W family are accused of home schooling from 1995 to 2000 without notifying the superintendent or providing academic assessments. The superintendent is threatening prosecution for truancy for 1995-99, alleging that the family did not provide the "required materials," i.e., the academic assessments.

Status: The family has been advised that the statute of limitations has passed and that any prosecution would therefore be futile. However, we will defend in the event one is filed.
