Parents charged with educational neglect

Filed: February 13, 2001, Jessamine County

Nature of Case: Mother was summoned to court for “not cooperating with” a CPS investigation of educational neglect allegations. The parents refused to allow the social worker into their home to interview their daughter outside of their presence.

Status: The county attorney recognized that “not cooperating with” a CPS investigation was not an allegation of neglect. The petition was, therefore, defective, and he was not interested in a constitutional debate over the Fourth Amendment. At the initial hearing on February 26, 2001, the judge asked only that a copy of the notice of intent previously supplied to the school district be supplied again to all interested parties, including the cabinet representative. HSLDA sent the notice as ordered, so the case was dismissed.
