School District Jumps the Gun
March 16, 2006
At issue: The Susquehanna Community School District contacted a member family informing them that their claim for religious exemption from the Pennsylvania homeschool law could not be honored since a federal court had ruled recently against similar cases. The school district then demanded that the family immediately file certain documentation with them to prove the family was educating their children.
HSLDA action: Home School Legal Defense Association attorney Dewitt Black wrote the superintendent of Susquehanna Community School District informing him that the federal court case had not yet been decided, and that the superintendent was mistaken in his belief. Attorney Black further requested the school district not to take legal action against the families until the case had actually been decided.
Results: We believe the Susquehanna Community School District will understand their error and hold any action against our member family in abeyance until the case is decided.
