Court Rules Homeschoolers’ Religious Freedom Not Violated

The United States Court of Appeals for the Third Circuit today ruled that Pennsylvania’s homeschooling law, which is among the most burdensome in the country, does not violate the Free Exercise Clause of the United States Constitution. The court declined to address related claims brought under Pennsylvania’s Religious Freedom Protection Act, sending them back to state court for resolution. The case involved six Pennsylvania homeschooling families whose religious convictions regarding state control over education led them to challenge the state law.

“We’re disappointed in the ruling,” said HSLDA founder and Chairman Michael Farris, who represented the families. “We’re reviewing the 84 page opinion and considering an appeal to the United States Supreme Court,” said Farris.
