Harford County Drops Demand

A Home School Legal Defense Association member family filed a notice of consent for their 6-year-old daughter in Harford County. While reviewing the notice, the Pupil Personnel Worker realized there was no notice of consent on file for the three oldest children, only an "annual verification." The family had previously filed a notice of consent in another Maryland county for those children.

The Pupil Personnel Worker called the family and demanded that they file a notice of consent for their three oldest children. The family called HSLDA for advice.

HSLDA called the Pupil Personnel Worker and explained that Maryland regulations require that a family file a notice of consent only one time, after which a simple "annual verification" is generally required. After we assisted him in gaining access to the regulations, the Pupil Personnel Worker acknowledged that he did not have any legal authority to require the family to file additional notices of consent. He told us that the family did not need to send the school district any additional information.
