Public School Demands Exceed State Law
In addition to a declaration of intent to utilize a home study program, officials at Dalton Public Schools have been insisting that parents provide information beyond what is required by state law. Home School Legal Defense Association assisted two families at the beginning of this school year when they were told they had to provide a copy of their driver’s license or other picture identification, proof of residency, and proof of education.
According to the home study statute, the declaration of intent must include a list of the names and ages of the students enrolled in the program, the address where the home study program is located, and a statement of the 12 month period that is to be considered the school year for the program. No other information or supporting documentation need be provided prior to commencing the program.
After HSLDA Senior Counsel Dewitt Black sent a letter to the superintendent of Dalton Public Schools informing him that our member families were in full compliance with state law by filing the declaration of intent containing only the required information, the school officials made no further attempts to obtain the unauthorized information. Other member families who are asked by public school officials to provide more information than required by state law should contact us for assistance.
