Dear Idaho HSLDA Members:

In January of 2012, we reported to you that the Pocatello-Chubbuck school district had finally ended its unlawful policy forbidding a homeschool student from taking just one class—insisting that the student must instead take at least two classes.

Inexplicably, during the summer of 2013 the school system resurrected the discredited policy. At least one family was subsequently told their child would not be allowed to take a single class.

If you are considering having your homeschooled child take a single course from the school district this summer or fall, please do the following:

  1. Request to take the class at the earliest possible opportunity.
  2. Submit your request in writing.
  3. Ask for a written response.
  4. Submit it via certified mail, return receipt requested, and keep the green postal receipt when it comes back to you.
  5. If your request is rejected, send a copy of your request and the rejection immediately to HSLDA for evaluation.
  6. If your request is ignored, send us a copy of your request and the green postal receipt.

Pocatello’s recalcitrant behavior on this issue appears to be inexcusable. I have opened a line of communication with the school district and urged them to promptly fix their policy. However, if a family’s request to take a single class is rejected, we will review the situation for possible litigation. Court cases always take time, of course, which is why I am making the requests above.

Sincerely,

Scott A. Woodruff, Esq.,
Senior Counsel,
