Dear HSLDA Members and Friends,

Your calls are working, and House Bill 4005 has been assigned to a subcommittee for further review. The subcommittee is meeting on Monday, January 27 at 9 a.m. and will make its recommendation on HB 4005 to the full House Judiciary Committee. Please contact the listed members of the subcommittee and urge them to vote against HB 4005.

Action Requested

We have identified several members of the subcommittee who need to hear from you. Please contact these delegates and give them the following messages in your own words:

“I am calling to oppose HB 4005 which creates new and unnecessary misdemeanor criminal charges if a parent or guardian creates a ‘risk’ of bodily injury. Bodily injury means the potential for ‘pain, illness or impairment of physical condition.’ Parents who do not vaccinate their children, who spank their children, or who prefer non-traditional medicine could be at risk for criminal punishment because these could be argued to create ‘risks’ of these conditions. Risk is inherently subjective, and the definitions used in this bill are too vague to allow for criminal prosecution which ought to be reserved for the actual causation of harm or the creation of a more substantial risk of serious harm. Please oppose HB 4005.”
