====================================================================== From the HSLDA E-lert Service... ====================================================================== On the Case: Mike Farris Defends Homeschool Freedom at the Nebraska Supreme Court Dear HSLDA Members and Friends, Tomorrow is the day HSLDA founder Michael Farris goes before the Nebraska Supreme Court to defend our interpretation of the Nebraska private school law governing the initial filing of a notice. The Thacker family filed their first notice of intent with the Nebraska Department of Education after the public school had started during the 2011-12 school year. Their local prosecutor charged them with truancy, and they were convicted by the county court. On appeal, HSLDA was successful in having the parents' convictions thrown out. The prosecutor appealed, and in a surprise move, the Nebraska Supreme Court decided to skip the intermediate court of appeals and took the case itself. The state's position on homeschooling is troubling. In its brief, the prosecutor has argued that a child is presumptively enrolled in the local public school, unless the parent formally chooses otherwise. Mike Farris will be arguing that this is clearly contrary to Nebraska's well-established public policy that parents, not the state, possess the right to make educational decisions on behalf of a child.
