Dear HSLDA Members and Friends, Thank you for your calls! On Feb. 26, the Committee on Judiciary approved the Kansas Religious Freedom Protection Bill and sent it to the House floor for action. Your representative needs to hear from you now! The freedom to live out one's faith has been under attack since a 1997 U.S. Supreme Court case ruled that the U.S. Congress cannot give greater protection to faith-in-action than the way the Court itself interprets the First Amendment. That means it's up to individual states to restore the level of protection that has historically existed. H.B. 2203 will do that. ACTION REQUESTED Please call your Kansas state representative right away. A vote could take place at any time. Your message can be as simple as, "Please vote YES on HB 2203. Please protect religious freedom from being eroded." Use our Legislative Toolbox to find the name of your representative (be sure to type in your ZIP code). http://www.hslda.org/elink.asp?id=17381 BACKGROUND Recent U.S. Supreme Court cases have muddied the water on how religious freedom should be protected. One decision even implied that religious freedom should not be protected at the highest historic level unless another right, in addition, was on the line. This tendency to undermine religious freedom must be halted. HB 2203 accomplishes that by requiring that religious freedom be protected at the historic level--even when no other right is at stake. This means that a government agency can place a burden on your religious freedom only if it has a "compelling interest" and there is clear and convincing evidence that there isn't a way for the government to accomplish its objective in a way that is less burdensome. HB 2203 also says that it cannot be used to protect any action or decision that would end the life of any person or unborn child. The bill contains other safeguards. It says it cannot be used to support any type of legal system other than those created by law. It cannot be used in a way that interferes with safety issues in prisons.
