====================================================================== From the HSLDA E-lert Service... ====================================================================== Senate Threatens Wyoming Constitution and Freedom Dear Wyoming Members and Friends, Urgent action is needed to oppose Senate File ("SF") 104 which passed the Wyoming Senate and is now moving forward in the House of Representatives. If the bill passes in the House, it needs only the governor's signature to become law. The bill has been assigned to the House Appropriations Committee. It is reported that it was assigned there because there were not enough votes in the Education Committee to pass it. Your calls to the committee are needed to stop this bill. SF 104 would strip virtually all authority away from the current elected state superintendent of public instruction. The bill creates a new un-elected position, a director of public education who would be appointed by the governor. The state Board of Education is also appointed by the governor. Article 7, Section 14 of the Wyoming Constitution explicitly calls for the election of a state superintendent of public instruction. If the legislature wishes to change this it should do so by modifying the Wyoming Constitution rather than by political act. HSLDA believes that protecting the integrity of the Constitution is important and that representative government is better served when elected officials are authorized and empowered to carry out their constitutional duties. Furthermore, the current state superintendent is on record explicitly in support of home education and parental rights. We are asking you to take action to support the Wyoming Constitution. You can view or print the introduced bill from the Wyoming legislature website here: http://legisweb.state.wy.us/2013/Introduced/SF0104.pdf ACTION REQUESTED Please contact the members of the Wyoming House Appropriations Committee and urge them to oppose SF 104. A list of committee members and their contact information is below. In your own words, give the Representatives the following message: "I am calling to oppose SF 104. This bill creates the unconstitutional office of director of the Department of Education. This puts too much power in the hands of a single unelected official and is contrary to the spirit and intent of the Wyoming Constitution. Although the constitution does give the legislature power to assign the duties of the superintendent, the Wyoming Constitution presumes an elected state superintendent accountable to voters for schools. The legislature should seek changes like this through a constitutional amendment, rather than simple legislation. Stripping an elected constitutional office-holder of her duties goes against the constitution and takes authority away from the people. Please vote against SF 104."
