====================================================================== From the HSLDA E-lert Service... ====================================================================== California - Vaccination Waiver Threatened JOINT LEGISLATIVE ALERT UPDATE- July 10, 2012 From: Mike Smith -- HSLDA and Roy Hanson -- Family Protection Ministries Bill: AB 2109 (as amended 6/20/12) - Vaccination Waiver Severely Threatened Author: State Assemblymember Richard Pan, M.D. Position: Strongly OPPOSE Thank you for your important phone calls and letters! Status: Unfortunately, AB 2109 passed the Senate Health Committee on June 27. This bill's next and final hearing before going to the full Senate for a vote will be in the Senate Appropriations Committee. No date for the bill's next hearing has been assigned yet. We will continue our strong advocacy in your behalf against AB 2109 in the Senate and will closely monitor the bill until the next hearing date. Please be watching for our next alert, as we will need your help just before the next hearing in August. We must not give up. There have been victories in the past with bills going all the way through the legislature and then being vetoed by the governor. Below is the record of the vote taken at the June 27 Senate Health Committee hearing. In spite of all your phone calls and letters, our best efforts during the hearing, and also our contacting the individual members and consultants of the committee before the hearing, there was only one courageous vote against the bill - Senator Joel Anderson from San Diego. Ayes 7 - Noes 1: Pass Ayes Hernandez (D) Harman (R) Alquist (D) Blakeslee (R) DeSaulnier (D) Rubio (D) Wolk (D) Noes Anderson (R) Not Voting DeLeon (D) Summary of Concern: AB 2109 would set a dangerous precedent for further government encroachment upon what has historically been the responsibility of parents - to make voluntary informed decisions concerning the medical care of their children. This bill creates a new additional requirement for parents who choose to exercise the current right to a personal beliefs waiver to exempt their child from one or more of the vaccinations required for school enrollment. AB 2109 would require a parent to obtain the signature of a doctor, stating that he has provided the parent with information about the benefits and risks of vaccinations and about specified communicable diseases, before their child would be exempted. We will be sending another e-lert when the next action is needed in August. The legislature reconvenes on August 6 after their summer recess.
