Dear HSLDA Members and Friends: Thank you for your calls in support of the Religious Freedom Restoration Act. The Senate Rules Committee took action as you requested and placed HCR 2657, which has now been renamed SCR 84, on the regular calendar. The full Senate will likely vote on this resolution tonight. The House will then need to concur with SCR 84 - the House vote will likely take place tomorrow. If both the House and Senate vote in favor of the resolution, the Religious Freedom Restoration Act will be sent to an interim study committee over the summer. You can use the following message in your own words: "Please support SCR 84. This resolution will allow the Religious Freedom Restoration Act (RFRA) to be studied over the summer. RFRA is necessary to adequately protect religious freedom in West Virginia." Flores that the 1993 federal Religious Freedom Restoration Act (RFRA) was unconstitutional. By doing this, the Court gave the lowest level of protection to religious liberty. Under this minimal standard, the state can override a citizen's right to freely exercise his or her religious beliefs by simply proving that its regulation is "reasonable." Since nearly all state regulations can be determined to be "reasonable," religious freedom is exceedingly limited. If passed, the West Virginia RFRA would restore the high standard of protection for religious liberty previously guaranteed in the federal RFRA and earlier Supreme Court decisions.
