Idaho--Pocatello Passes Unlawful Policy--Heads Up Elsewhere!

Dear HSLDA Members:

Despite opposition from homeschoolers, the Pocatello-Chubbuck school
district on Tuesday gave its final approval to a policy which,
contrary to state law, prohibits homeschoolers from dual enrolling
unless they are enrolled in public school programs for at least 150
minutes daily.

State law gives homeschoolers the right to participate in "any" public
school program. It gives schools authority to adopt appropriate
procedures. However, a procedure that categorically excludes an entire
class of citizens from access is contrary to the will of the
legislature.

Because of the current cloudy situation, families who wish to obtain
access to a public school program should go ahead and submit their
request as usual--preferably in writing--but they should submit it as
early as possible and practical. This will give all those involved
more lead time to respond if the request is denied.

If you are a private homeschooler (i.e., the child is not enrolled in
an online public school), HSLDA would like to know immediately if
Pocatello-Chubbuck rejects your request to dual enroll.

If you live in a school district other than Pocatello-Chubbuck, please
consider checking your school district's agenda on a regular basis to
see if a Pocatello-type policy is in the works. While Pocatello
homeschoolers were not able to stop the policy, it's entirely possible
that similar policies could be stopped elsewhere, especially if
homeschoolers get involved early in the process.

Families may have very good reasons for not participating in public
school programs at all. However, since access is a clear right under
state law, HSLDA, CHOIS and ICHE will continue to follow this issue
closely.
