====================================================================== From the HSLDA E-lert Service... ====================================================================== Reminder: Annual Notice to State Department of Education Dear HSLDA Members: HSLDA hopes that you have had a wonderful summer! This is a reminder for those operating under Vermont's homeschool law to file your annual enrollment notice for each child between ages 6 and 16 to the commissioner of education. The commissioner's guidelines for home study state that the enrollment notice must be received on or before Labor Day in order to qualify for the "minimum course of study exemption." While HSLDA disagrees with this interpretation of the law, we have litigated the issue, and a hearing officer has indicated that the commissioner's interpretation may be upheld. Families who wish to avoid a hearing over the issue should file paperwork before the deadline. At a minimum, a family who has filed Form A (or HSLDA's Notice of Intent to Homeschool) only should be deemed to have met the deadline, after which they will have 14 days to complete the notification. A family may choose to do this in cases where a teacher's evaluation is late, or they are making changes to the curriculum and are waiting for more information to complete the minimum course of study description. Vermont Statutes sec. 166b requires a home study program to file "a detailed outline or narrative which describes the content to be provided in each subject area of the minimum course of study." An outline or narrative for a child with a disability must include any special services or adaptations that will be made to accommodate the disability. Families who successfully complete two consecutive school years of home study receive a "minimum course of study exemption" and are not required to provide this detailed outline for every child of compulsory attendance age. However, all families must submit a detailed outline for each child who is 12 years old at the time the enrollment is filed.
