====================================================================== From the HSLDA E-lert Service... ====================================================================== South Dakota--File Form No Later Than First Day of School, Or Else Dear HSLDA Members and Friends: Custer School District 16-1 recently sent a letter to families asking them to submit their homeschool forms so the school board could act on them at its August 8 meeting. With the changes enacted through HB 1133, however, it is not necessary for school boards to take any action at all. Homeschool children are considered excused from public school attendance immediately upon the filing of the application for excuse. I spoke with the Custer superintendent this morning and explained that school board action is no longer necessary. He was not aware of the change in the law until my call. I expect many other superintendents are likewise unaware. The school system's letter also said that if the school board did not receive each family's form by the first day of school, August 22, they would be required to contact the state's attorney. Families should make careful note of the first day of school in their district, and make certain their application for excuse is on file no later than that date. Sending your form by certified mail-return receipt requested, and keeping the receipt, should give you solid proof your form was received before the first day of school. HSLDA and homeschool representatives have been in discussions with the South Dakota Department of Education to update the homeschool form so that it reflects the changes the legislature enacted early this year, and to correct other problems. We expect the updated form will be available on the Department's website by the end of next week. This should give families plenty of time to file it before the first day of school.
