====================================================================== From the HSLDA E-lert Service... ====================================================================== Illinois--Boone County Showdown on Wednesday June 13, 2011 Dear Boone County Members and Friends, There is a strong division of opinion on the Boone County board as to whether to adopt the proposed truancy-curfew ordinance. What you do between now and Wednesday could prove decisive! Every homeschooled child could become a suspected truant under the ordinance. If your child receives a citation for alleged truancy, or for allegedly being out in public while truant, the judge might dismiss the charges as soon as you tell him you homeschool the child. Or he might tell you that he can't rule until you have proved that your homeschool program complies with all the Levisen factors. Most families assume that their homeschool program meets the Levisen requirements for being a private school. But few would want to stand in front of a judge and prove it. But this is exactly what could happen when a homeschooled child gets a citation. Vindication of his innocence could hinge on your ability to prove your homeschool program satisfies the requirements set forth in the Levisen case. Some of these requirements have a strongly subjective component. It is therefore impossible to predict how a given judge would rule on a given day. If enacted, some families out of fear will keep their children inside. It is unacceptable to pass an ordinance with the potential for creating this level of pervasive fear. ACTION REQUESTED 1. Contact members of the Boone County Board and ask them to vote "no" at Wednesday's meeting. 2. Attend the meeting Wednesday, June 15 at 6:30 PM.
