Dear HSLDA Members and Friends: Thanks to Governor Daugaard's signature yesterday on HB 1133, as of July 1, school boards will no longer have the power to approve or disapprove the initiation of a homeschool program. This brings to an end the era when a school board could use its approval power illegitimately to delay or deny homeschooling. ACTION REQUESTED If you have not done so already, please consider sending a note of thanks to the primary sponsor, Representative Lance Russell (Custer, Fall River, Pennington), as well as Senator Elizabeth Kraus (Mead, Pennington), who sponsored the bill in the Senate. BACKGROUND Other requirements for homeschooling remain in effect as before, including a school board's power to require a homeschool program to stop under limited scenarios. It was generally understood that school boards were REQUIRED to give their approval to applications for exemption from public school attendance, that is, it was non-discretionary. But a couple of school boards recently delayed or denied applications for exemption for bogus reasons. They acted as if they had the power to decide if a family could start homeschooling. Even though they really had no such power in those cases, their delay meant that families were exposed to the possibility of prosecution for truancy. The new law prevents school boards from placing families in jeopardy with their delays. South Dakota Christian Home Educators worked hard to make this dream become a reality.
