Dear HSLDA Members and Friends, Thank you for your calls to Senator Maloney! They are having an impact! A powerful response from families in his district may convince him to withdraw his bill (SB 136) that would mandate that all homeschool children (and all private school children) register with the state. At this point we recommend that only residents of Maloney's district contact him (see yesterday's e-lert for details http://www.hslda.org/elink.asp?id=10200 ). One or two families have looked at the first few pages of the bill and wondered whether homeschoolers might be exempt. Reading to the very end of the bill, however, it's clear that only public school students are exempt from registration. Page 7 of the bill would add the following language (in caps) to the Illinois compulsory attendance statute, 105 ILCS 5/26-1: "The following children shall not be required to attend the public schools: 1. Any child attending a private or parochial school where children are taught the branches of education taught in the public schools, and where the instruction is in the English language, PROVIDED THAT THE PARENTS OR LEGAL GUARDIANS OF THE CHILD ANNUALLY REGISTER THE CHILD WITH THE STATE BOARD OF EDUCATION IN ACCORDANCE WITH PROCEDURES PRESCRIBED BY THE STATE BOARD OF EDUCATION." "Provided that" in this context means "only if." It is clear therefore that under this bill, only public school children would be exempt from registration.
