====================================================================== From the HSLDA E-lert Service... ====================================================================== April 15, 2010 West Virginia--Effects of the Compulsory Attendance Age Increase Dear HSLDA Members and Friends: West Virginia House Bill 4593 was recently signed into law by the governor, increasing the age of compulsory school attendance from 16 to 17. However, the legislature's use of vague language regarding the effective date creates some uncertainty. According to the bill, the age increase begins "with the 2011-2012 high school freshman cohort class of students." HSLDA will be analyzing this legislation carefully and will revise our legal analysis to provide you with the information you will need to be able to comply with the law. We will inform you when our analysis has been completed. At this time our position is that students who are 16 years old for the 2010-2011 school year are not affected by this increase. This means that homeschoolers may confidently cease sending their notice of intent to school districts for their students who are 16 years old for the next (2010 - 2011) school year. On a positive note, the House of Delegates designated March 9, 2010, as "West Virginia Home School Day." House Resolution 29 states that homeschooled students exhibit "self-confidence and good citizenship and are prepared academically to meet the challenges of today's society." Further, the resolution recognizes homeschool students, teachers, and families for their "dedication to excellence in education."
