====================================================================== From the HSLDA E-lert Service... ====================================================================== Virginia--Warren County Report Defends Unlawful School Board Policy Dear HSLDA Members and Friends: The Warren County Report recently published an article entitled "School board pulls back from religious exemption policy" in which it defended the school board's unlawful March 11 religious exemption policy. Space is not sufficient to address every error and exaggeration in the article, but one deserves special attention. A rather long, muddled sentence on page 7 of the publication concludes, " ... the fact that the county policy would require an explanation as to why licensed homeschooling options would not fit a family's religious educational needs, appears unacceptable." The March 11 policy is not just "unacceptable" -- it is unlawful. In Johnson v. Prince William County School Board, the Virginia Supreme Court ruled that it is unlawful for counties to require religiously exempted families to prove that neither home instruction under the standard statute nor private schooling would accommodate their beliefs. And, of course, homeschoolers are not "licensed." The school board's March 25 decision to suspend the unlawful policy is commendable. But a policy that is only "suspended" can still cause trouble. Further action is needed to make sure it is gone for good. April 19 will mark the 19th anniversary of the Johnson decision. Let's hope that at least by that time no one is trying to defend the unlawful policy.
