====================================================================== From the HSLDA E-lert Service... ====================================================================== March 1, 2010 West Virginia--Calls Needed TODAY to Protect Religious Freedom! Dear HSLDA Members and Friends: The Senate Judiciary has not yet heard SB 638, the West Virginia Religious Freedom Restoration Act. In order for this bill to pass, the Committee must make a report so that it can be read in the Senate. ACTION REQUESTED Please call Senate Judiciary Chairman, Jeff Kessler, and Majority Leader, Truman Chafin, today and ask them to bring SB 638 up in committee. Because this legislation applies to all West Virginia citizens, you should NOT identify yourself as a homeschooler. Give the following message in your own words: "Thank you for supporting SB 638. Please bring this bill up in committee as soon as possible so that it can be reported on and then read in the Senate." Senator Jeffrey Kessler - Judiciary Chairman (304) 357-7880 jeff.kessler@wvsenate.gov Senator Truman Chafin (304) 357-7808 truman.chafin@wvsenate.gov BACKGROUND On June 25, 1997, by a 6-3 majority, the U.S. Supreme Court ruled in *The City of Boerne v. Flores* that the 1993 federal Religious Freedom Restoration Act (RFRA) was unconstitutional. By doing this, the Court gave the lowest level of protection to religious liberty. Under this minimal standard, the state can override a citizen's right to freely exercise his or her religious beliefs by simply proving that its regulation is "reasonable." Since nearly all state regulations can be determined to be "reasonable," religious freedom is exceedingly limited.
