====================================================================== From the HSLDA E-lert Service... ====================================================================== Colorado--Clarification of Home Education Law Dear HSLDA Members: Last week, we sent an email reminder to parents to submit their annual notices of intent. Since then, we have been asked to clarify a few nuances of Colorado home education law. First, the notice of intent reminder is only for parents who are operating a home-based educational program for their children. If your children are enrolled in an independent (also known as a "satellite" or "umbrella" school) located in Colorado, you do not need to submit a notice of intent to the school district. It has come to our attention that some families may believe that doing both provides "extra protection." This is not the case. A family who does both is in no better legal position than a family who is in compliance with only one of the statutes. (You can review the distinction between these two options for education at home at http://www.hslda.org/laws/analysis/Colorado.pdf). Second, although Colorado law requires that each child between the ages of 6 (by August 1) and 17 attend public school, parents who intend to home educate are exempt from this requirement. These parents must submit a notification of intent to home educate to a Colorado school district in the year that their children are 6 by August 1, but they do not have to begin instruction until the children are 7 years of age. In addition, parents who home educate are not required to instruct students who are beyond the age of 16. Third, if you operate a "home-based educational program," you are required to have your students' academic progress evaluated at grades 3, 5, 7, 9, and 11 by either a qualified evaluator or by using a nationally standardized achievement test. In this case you must send the test scores or evaluation to either the school district with which you file your notice of intent OR to an independent or parochial school within Colorado. If you choose to submit the scores to a nonpublic school, then you must notify the school district in which you filed your notice of intent of your choice.
