Dear HSLDA Members and Friends: On Thursday the Senate passed Assembly Bill 11463, the bill that will allow homeschool students to receive special education services. While the Senate was the first to sponsor legislation to restore services for homeschool students, the Assembly passed a slightly different version first, and the Senate then passed the Assembly bill. While Assembly Bill 11463 has passed the legislature, the bill must now be sent to Governor David Paterson for his signature for it to become law. Once the bill is sent to the governor, he will have 30 days to sign it. Please thank the leadership of both the Senate and the Assembly for passing this bill. Your efforts were extremely important in moving these bills forward. REQUESTED ACTION 1) Please email the following members of the Senate and the Assembly and give them this message in your own words: "Thank you for acting quickly and passing Assembly Bill 11463. This bill will allow homeschool students with disabilities to be eligible for special education services as other nonpublic school students are." This bill will allow homeschool students with disabilities to be eligible for special education services as other nonpublic school students are." BACKGROUND In January the New York State Education Department (NYSED) wrote a letter to every school district in the state informing them that special education services were not authorized to be provided to homeschool students. Due to your grassroots efforts and those of many dedicated parents and state organizations such as LEAH, legislation was drafted by the New York Board of Regents and the NYSED to restore services to those homeschool children who need special education services. Assembly Bill 11463 will now be prepared to be sent to the governor's office for his signature. Once the governor receives the bill, he will have 30 days to sign it. If the governor does not sign the bill, it will not become law. At this time we have no reason to believe Governor Paterson will not sign the bill, but we will keep you posted if any further action is needed.
