HSLDA--Help Mike Farris Prepare for California Case

HSLDA--Help Mike Farris Prepare for California Case

Dear HSLDA Members and Friends,

On June 23, the California Court of Appeal will conduct the rehearing
for the case of In Re Rachel L. A team of lawyers representing the
father and various friend-of-the-court groups will provide oral
argument. Our Chairman, Michael Farris, will close out the argument
for the father's side of the case.

Mike Farris and Jim Mason, our Senior Litigation Counsel, have been
deeply involved in every stage of this case since the February 28
ruling which declared homeschooling to be illegal in California
(unless the teacher has a state credential.)

Mike and Jim did the actual research and preparation of the motion for
rehearing as assistance to the counsel of record. This motion resulted
in the upcoming hearing and vacating the prior decision.

Mike and Jim have provided substantial help to a number of the other
parties and amici in the case. And Mike wrote (with assistance from
Darren Jones), the brief from HSLDA that defends the academic and
constitutional legitimacy of homeschooling itself.

At the close of the oral argument, it is clear that the most
experienced oral advocate on homeschooling issues in the country needs
to be standing at the lectern answering the judges' questions about
homeschooling and making a comprehensive argument as to why this
family should win and all homeschoolers should win. And that person
is Mike Farris.

As many of you know, Mike divides his time between HSLDA and Patrick
Henry College. Throughout this spring, Mike has been required to
devote significantly more time to HSLDA in large part because of this

Usually, there is enough flexibility in what Mike does to allow him to
move easily between the two institutions to achieve what needs to be
done in both spheres.

But this is one of those crunch moments where Mike simply cannot do it
all--something has to give.

Patrick Henry College ends its fiscal year on June 30. There is a
significant budget shortfall this year. One of Mike's chief duties
for the college is fund-raising--and from the college's perspective,
he needs to spend this next week on the phone full-time raising money
for the college.

But, because of the oral argument next Monday, he needs to spend
full-time preparing for this case.

There is no doubt what Mike is going to do. He is going to spend his
time preparing for this case.

But, I want him to be able to do this with the weight of the other
responsibility off of his shoulders and out of his mind so that he can
concentrate on our California case.

Would you consider a gift to the scholarship fund at Patrick Henry
College right now?

I know that this seems a little unusual as a way to help support the
California case--but it is the straightforward reality. Mike Farris
needs to concentrate on this case and we need to help him in this
other area if we possibility can.

In our brief to the California Court of Appeal we used information
about the students at Patrick Henry College as part of our evidence on
the success of homeschooling. We pointed out that 12 of the top 16
students in Moot Court (legal debate) in the country were from PHC and
were all homeschooled. We even pointed out that the article about the
California homeschool case that appeared in USA Today was written by a
young woman who was homeschooled in California. She was a student at
Patrick Henry College.

The success of PHC helps advance homeschooling in general. And in
this particular situation, I ask you to simply consider a gift to PHC
as a way to help my overburdened friend, Mike Farris.

Please help as you feel led.

Thanks so much for your consideration.

J. Michael Smith
