Nebraska--L.B. 1141 Battle Not Over--Senator Schimek Introduces Resolution to Study Nebraska Homeschooling
Dear HSLDA Members and Friends:
On March 31, 2008, Senator DiAnna Schimek introduced Legislative Resolution (L.R.) 369, which requires the legislature's Education Committee to "examine policy changes that should be pursued in order to provide further guidance and oversight of Nebraska's home schools." The resolution requires the committee to study:
1. The current laws governing Nebraska non-accredited schools and the laws' original legislative intent;
2. Improvements that can be made to the existing law, in light of the increasing number of homeschoolers and current trends;
3. Data on Nebraska homeschooled students' performance;
4. Current case law that allows states to govern home education; and
5. Ways for Nebraska to sufficiently regulate homeschoolers, including testing and other evaluative methods.

The Committee must then prioritize it, along with other interim studies it has been assigned, and file a report to the clerk of the legislature before the legislative session ends on April 17, 2008.
Each study is assigned a priority number -- 1, 2, or 3. Committee staff is fully responsible for and conducts all "1" studies, participates to some extent in "2" studies, and is only available to provide expertise to the sponsoring senator of a "3" study, who is fully responsible for conducting it. L.R. 369 has not yet been assigned a priority number.
At this time, there is no need to contact the Education Committee regarding L.R. 369. HSLDA and the Nebraska Home Educators Association (NCHEA) are working together to monitor this legislation and develop an effective strategy. We let you know when the Committee has assigned L.R. 369 a priority number, and, at that time, what, if any, action is needed. Thank you for your support of homeschooling freedom in Nebraska!
