Virginia--Bills Allowing Social Workers to File Petitions to be Fixed
Dear HSLDA Members and Friends:
Thank you for your phone calls! These bills have now received a high level of attention. We have received assurances that H.B. 1328 and S.B. 788 will be amended to make it perfectly clear that the only motions and petitions a social worker can file are those relating to monetary support. If these amendments are truly made, we will no longer oppose the bill. Based on the assurances we have received, we recommend that you no longer make calls on H.B. 1382 and S.B. 788. BACKGROUND You may have received erroneous information to the effect that these bills would cause no change, but merely put in writing what has been going on for 20 years. That may have been the intent, but that is emphatically not what the bills would do if they become law without the amendments. Here is the key language. Lines 43 and 44 (both bills have the same line numbers), unamended, allow "nonattorney employees of the Department of Social Services" to "complete, sign and file petitions and motions with the clerk." Notice it does not limit what KIND of petitions or motions. Lines 272-3, unamended, say "Nothing herein shall prohibit nonattorney employees of the Department of Social Services from completing signing, and filing petitions and motions ...". Again, it does not limit what kind of petitions and motions can be filed. Corrective language has been developed that will solve the problem and make it clear that it relates only to petitions and motions for support. The language must be added in both places (lines 43-44 and lines 272-273) to fix the problem. You may have also been told that various people and agencies supported the bill as written. I received a call a few minutes ago from a representative of the Attorney General's office agreeing with me that the bill was problematic as written and that the bill needed to be amended in two places. Bill sponsor Del. Salvatore R. Iaquinto has also shown willingness to amend the bill to fix the problem. I suspect that the people and organizations who supported the bill as written did not understand what it really would have done. Thank you for standing with us for freedom. Scott A.
