====================================================================== From the HSLDA E-lert Service... ====================================================================== August 21, 2007 Ohio--Outdated Policy Creates Stir Dear HSLDA Members: When Ohio's Dublin City Schools began telling homeschoolers they must enroll their children in the local public school before they could receive an excuse from compulsory public school attendance, homeschoolers were fast to act. Members quickly telephoned the Home School Legal Defense Association to let us know about the issue. Staff Attorney Michael Donnelly called local school officials and discovered the source of the problem--new employees were trying to implement an outdated policy, which indicated that only enrolled students could receive excuses from compulsory attendance. Attorney Donnelly explained that Section 3301-34-03 of the Ohio Administrative Code, which governs the procedure for home education notification, does not require parents to enroll their homeschooled children in the local public school. HSLDA found the Dublin City Schools to be cooperative and responsive. They quickly promised to contact the affected families and inform them that their notification paperwork would be processed according to the regulation. Misunderstanding of home education laws is a common problem at the beginning of the school year. With new staff grappling with new positions and unfamiliar regulations or policies, it is natural to expect that these types of situations will occur, at least (we hope) occasionally.
