Homeschoolers are now closer to fair access to federally funded special education services. On January 31, the Senate Education, Health and Environmental Affairs Committee held a hearing on Senator James Brochin's S.B. 116, the bill that will give homeschoolers the same access to federally funded special education services that private school students already receive. HSLDA attorney Scott Woodruff was unable to attend because a winter storm the night before made roads in Northern Virginia impassable. However, Maryland attorney Scott Somerville, General Counsel for Lampstand Press (Tapestry of Grace), attended at HSLDA's request and provided crucial testimony. State legislative personnel had attached a "fiscal note" to the bill indicating it would cost the state millions of dollars. Attorney Somerville thoroughly refuted this assertion during his testimony at the hearing. An amendment was subsequently added to the bill to make it abundantly clear that only federally-funded services were at issue. Other homeschool families offered testimony in favor of the bill, as well. The committee voted in favor of the bill on March 9. On March 13, the Maryland Senate voted 46-0 in favor of S.B. 116. The bill now moves to the House of Delegates for action. This common sense bill does not appear to be controversial, so we are not asking families to take any further action at this point in time.
