====================================================================== From the HSLDA E-lert Service... ====================================================================== September 22, 2006 Illinois--Judge Dismisses Protect Marriage Illinois' Lawsuit Dear HSLDA members and friends: The marriage petition, started by Protect Marriage in Illinois (PMI), was submitted in May with almost 350,000 signatures! Thank you for your participation in signing the petition. Unfortunately, the state's pro-homosexual left, led by the ACLU, did all they could to stop the referendum from appearing on the November ballot. In addition to the pressure the ACLU has been placing on the government to keep the referendum from appearing on the ballot, the State Board of Election made an administrative decision to disqualify the referendum for the ballot due to slight discrepancies between the signatures on the petition, and how they compared to those registered to vote in the state. Director David Smith of the Illinois Family Institute did not give up so easily. He had a brief filed with the 7th Circuit Court of Appeals challenging the constitutionality of the state's referendum law. The brief was dismissed, and Smith, partnering with the Alliance Defense Fund (ADF), filed an appeal. Judge Elaine Bucklo recently handed down her decision, which affirmed the lower court decision dismissing the complaint. Basically, she set a very low standard for the state in upholding citizens' rights to petition their government. Although it looks as though the referendum will not appear on the November ballot, we are not giving up hope. According to David Smith, "Preserving marriage as between one man and one woman in the Illinois State is extremely important to the families of this state. The Protect Marriage Illinois project will continue to work toward the goal of a constitutional amendment."
