Tennessee--Notice of Intent Deadline

Dear HSLDA members:

For those of you planning to comply with Tennessee's homeschool law
for the 2006-2007 school year, we are providing the following
information by way of reminder.

Parents conducting a homeschool which is not associated with a
church-related school must notify the local school district of their
intent to conduct the homeschool by August 1 of each school year.
However, if the notice is not given by August 1, but is given by
September 1, it may be submitted upon payment by the parent of a
penalty of $20.00 for each week or portion thereof by which the notice
is late. This penalty payment shall not exceed $80.00 and shall be
charged per family regardless of the number of children attending the
homeschool. The superintendent has the discretionary authority to
waive the September 1 deadline for good and sufficient reasons.

For parents conducting a homeschool which is associated with a
church-related school, there is no provision in the homeschool statute
requiring that any notice be given to the local public school. Thus,
the August 1 deadline does not apply to these students. However, for
those students whose homeschool is associated with a church-related
school and who are in grades 9-12, parents must register them with the
local school district. There is no deadline for this registration,
although we believe this registration should take place on or about
the time the parent begins to conduct the homeschool each year.

Parents also have the option of having their children attend a
church-related school. This is not homeschooling, because the
church-related school is not being conducted by parents or legal
guardians. This school is being operated by a denominational,
parochial, or other bona fide church organization. Under this option,
there is no need for parents to comply with the homeschool law, which
includes notice, registration, or testing through the public school.
This option is based upon a memorandum from the Tennessee State
Department Education dated February 18, 1999, recognizing that
children attending a church-related school through its satellite or
extension program in their home and being taught by a parent are in
compliance with Tennessee's compulsory attendance law.

Please note that HSLDA will defend any member family whose right to
teach their children at home is challenged by the state--even if their
religious convictions prohibit them from complying with the state
homeschool law. The information in this email is provided to those
who intend to comply with state law and to assist you in meeting the
statutory deadline.
