New York--A Request to Help Expand Testing Choices

Dear HSLDA members and friends:

Home School Legal Defense Association is committed to protecting the
rights of parents to direct their children's education at home. Part
of this mission in New York includes advocating on behalf of our
member families to bring greater flexibility to the current

Annual assessments are one of the burdens currently placed on
homeschooling families in New York. According to Section 100.10 of the
Commissioner's Regulations a home instruction program is to provide an
annual assessment of their child's progress with their fourth
quarterly report.

Currently, a parent is required use the Iowa Test of Basic Skills, the
California Achievement Test, the Stanford Achievements Test, the
Comprehensive Test of Basic Skills, the Metropolitan Achievement Test,
a State Education Department test or another test approved by the
State Education Department every other year between grades 4 through 8
and every year in high school. In grades 1 through 3 and the
alternating years between grades 4 through 8 an alternative written
narrative evaluation may be use.

With the Homeschool Freedom Bill, which was introduced last year as
Senate Bill 3641, parents would be given the freedom to use any
standardized achievement test, along with those approved by the State
Education Department, or have the alternative written evaluation done
regardless of the grade level.

While we continue to work with Loving Education at Home (LEAH) and
other New York homeschool groups for greater freedom it would be
helpful to know what test or tests your family has used in the past
and the names of any standardized achievement tests that you would
like to use but are prevented from taking. We would like to compile a
list of the tests that are generally used in New York along with those
that could be added in order to expand the choices.

Action Requested:

Please e-mail LEAH at with the name of the test or
tests you have used in the past and the name of any tests you would
like to use but currently cannot. Only the names of the tests are
needed and could simply be included in the subject line of any e-mail.

Looking ahead:

HSLDA will continue to fight for greater freedom in New York for all
homeschool families both in advocating for better laws and working to
defeat legislation that could negatively impact homeschoolers.

Due to the recent proposals by the Board of Regents to lower the
compulsory age to 5 and make kindergarten mandatory we expect
legislation lowering the compulsory school age in New York to be
introduced at any time. We will need your help to defeat this
