North Dakota--Favorable Legislation Signed by Governor
Dear HSLDA members and friends:
I am pleased to report to you that North Dakota has enacted two bills having a favorable impact on homeschooling families.
First, on March 22, 2005, the Governor signed into law House Bill 1265 relating to the home education of students with developmental disabilities. Previously, the only children permitted to be homeschooled with developmental disabilities were those with autism. The new law expands the right of parents to teach a child with any developmental disability in a home education program.
North Dakota still has one of the most restrictive homeschool laws in the nation, but in the years since the original homeschool law was enacted in 1989, the Legislative Assembly has demonstrated a willingness to gradually improve the law. We expect this trend to continue as homeschoolers persevere in their efforts to gain more freedom.
The other bill signed into law by the Governor is House Bill 1267 approved on March 4, 2005. This bill complies with the federal requirements of the Keeping Children and Families Safe Act of 2003 relating to social services investigations. This new law requires social workers, at the initial time of contact with an individual subject to a child abuse or neglect investigation, to advise the individual of the specific complaints or allegations made against him. Additionally, the new law requires social workers to receive training regarding their legal duties to protect the constitutional and statutory rights of children and families during investigations and any treatment provided.
This requirement for the states was placed in federal law at the request of HSLDA because of the many instances of violations of parents' and children's rights by social workers during the course of investigations. This legislation will be beneficial not only to homeschooling families but to all families having contact with social services.
