Dear HSLDA members and friends: HSLDA and Representative Mike Gilb have been working for the last year on a breakthrough child welfare reform bill in the Ohio Legislature. As a result, SB 185 passed both chambers and was signed by Governor Taft on January 10, 2005. This new law will keep social workers properly chained by the Constitution and they will be liable if they do not respect the parental and Fourth Amendment rights of families. HSLDA developed a plan to pass this law. The child welfare reforms we advocated were not identified as homeschool issues and were not attacked for being partisan bills. Representative Gilb quietly worked behind the scenes. Consequently, the bill passed unanimously in both chambers. No doubt many legislators did not realize the importance of these amendments. They will give HSLDA and innocent families throughout the state leverage to keep social workers out of their homes. The bill, drafted by Senior Counsel Chris Klicka, requires child protective services workers to be trained in their duty to protect the statutory and constitutional rights of those they are investigating. All social workers in Ohio will now have to be trained on how to protect families' Fourth Amendment and parental rights. Furthermore, the new law will require all Ohio social workers to inform individuals, subject to a child abuse and neglect investigation, of the complaint or allegation made against them at the initial time of contact. This will bring an end to a social worker tactic of concealing the allegations until they get into your home and interrogate your children. This bill is based on the federal CAPTA law which HSLDA succeeded in passing through Congress and has helped enact in 11 other states. http://www.hslda.org/elink.asp?id=2021 HSLDA deals with cases on a daily basis where a social worker is investigating an innocent homeschool family because of false allegations. These tips, often supplied by those holding a grudge against home education, are often investigated aggressively. Social workers frequently demand to conduct physical inspections of homeschool children or to interview very young children outside the presence of their parents. Fourth Amendment and parental rights are often ignored. HSLDA gives special thanks to the diligent efforts of Bob Reed, legislative aid to Representative Mike Gilb.
