====================================================================== From the HSLDA E-lert Service... ====================================================================== September 14, 2004 Rhode Island--Changes to the Compulsory Education Law Dear HSLDA members and friends: The Rhode Island legislature recently made changes to both ends of the compulsory education law. Previously, a child was of compulsory age if he turned six by December 31. The 2002 General Assembly moved the date to September 1. As a result of this change, parents of a child who turns six, for example, on September 15, would not need to submit paperwork to the school committee until the following year. The 2003 General Assembly changed the upper end of compulsory attendance, but only for children who are "enrolled in school." The parents of a child enrolled in school at age sixteen or older must give written authorization to the school department if the child is to stop schooling before attaining his eighteenth birthday. With the exceptions noted below, children in a home instruction program are not "enrolled in school," so this will not affect the vast majority of homeschool families. However, the parents of a child previously enrolled in a Rhode Island school, who begin homeschooling after the child reaches age 16, would need to submit the required authorization to be exempted from the compulsory education law. Homeschool students who play on public school teams or enroll for one class at a public school should take extra care. The rules of the Rhode Island Interscholastic League require that a homeschool student be "listed on the rolls of the school" in order to play on the team. RIIL Rule 3.1.I. An official may claim that a child "listed on the rolls" is enrolled in school. One or two school districts over the years have tried to insist that homeschoolers "enroll" before they would process their paperwork. HSLDA has continued to advise families to refuse to enroll, since homeschooled children are not part of the public school system. This advice is more urgent now since "enrolling" in a school system may subject your children to a longer period of compulsory attendance.
