====================================================================== From the HSLDA E-lert Service... ====================================================================== August 24, 2004 Virginia--Wise County Schools to Correct Errors Dear Wise County HSLDA members and friends: In early July, homeschool families in Wise County received a letter ("WCPS Memo NO. 251") from Don Mullins, Assistant Superintendent for Administration. The letter contained several errors. The letter stated that "a notice of intent form must be submitted for each year..." Although families must submit a notice of intent, they do not need to use a form. They can simply submit a letter. The letter also stated, "If you elect option 1, 2, or 4, you must attach a program of study which satisfies the State Standards of Learning in language arts and mathematics..." Families homeschooling under option 1 or 2 are not required to include the SOLs for language arts and math. Only families using option 4 must use a curriculum or program of study that includes the language arts and math SOLs. The letter further stated, "by August 1st of next year you must complete this process again..." The notice of intent is due August 15th, not August 1st. Evidence of progress is to be submitted by August 1st. The notice of intent form asks parents to submit their social security number. Federal law requires a government agency to specify whether listing one's social security number is voluntary or mandatory, and if mandatory, the legal basis. The Wise County form does not comply with this mandate. We spoke with Mr. Mullins on August 23. He readily acknowledged the errors and agreed to correct them. He also agreed to our request to expunge any social security numbers that families submitted in response to the non-compliant form. Sincerely, Scott A. Woodruff, Esq.
