---------------------------------------------------------------------- From the HSLDA E-lert Service... ---------------------------------------------------------------------- September 12, 2003 Dear HSLDA Members and Friends: The Special Election on September 23 has the potential to undermine the New Mexico state constitution. Amendment 1 poses a significant threat to home education, and we urge our member families to oppose it. Please vote "no" on Amendment 1 on September 23. Amendment 1 replaces the entire education administration with a governor-appointed cabinet-level Secretary of Public Education and also creates a public education commission. Under current law, voters from every political party help elect a representative Board of Education. If Amendment 1 passes, the governor will effectively determine education policy. The last line of appeal for a homeschooler in New Mexico is the state Board of Education (elected and appointed members who are charged with setting policy and hiring the state superintendent.) State law declares that only the Board of Education can require a home schooled student's return to public or private school. This power has NEVER been used. If this power is invested in a political appointee with no one to answer to but the governor, the right to home school could be infringed without any public accountability. Under current law, voters choose the Board of Education. No special interest group can control that vote. That would change if Amendment 1 passes. Each year, the National Education Association (NEA) passes a resolution against home education. We don't want them telling the governor who to pick as the next Secretary of Public Education. New Mexico's state-wide homeschool organization, CAPE-NM, opposes Amendment 1. HSLDA joins them in this recommendation. Please vote against Amendment 1 on September 23. Scott W. Somerville, Esq.
