---------------------------------------------------------------------- From the HSLDA E-lert Service... ---------------------------------------------------------------------- July 14, 2003 Dear HSLDA Members and Friends, Thank you for calling in support of Senate Bill 12, the Religious Freedom Restoration Act (RFRA), in the legislature and before the Governor. Governor Bob Holden heard your message and signed the legislation on July 9, making the RFRA law in the state of Missouri. Missouri is the 13th state to pass a RFRA restoring the original constitutional protection of your fundamental right to freely exercise your religious beliefs, a right which was damaged by the U.S. Supreme Court a few years ago. It is important for states to stand against harmful rulings of the U.S. Supreme Court. Homeschoolers in most of the 13 states played a significant role in the RFRAs becoming law. The passage of this law means that families who are homeschooling for religious reasons are better protected from government intervention than ever before. Home School Legal Defense Association can use this new law to defend the rights of homeschoolers to freely exercise their religious beliefs against over zealous government officials. The Missouri RFRA restores the high standard of protection for religious liberty previously guaranteed in the federal RFRA and early Supreme Court decisions. Under the Missouri RFRA, if an individual's religious belief is in conflict with a state regulation, the state will have to prove, with evidence, that its regulation is essential and the least restrictive means to fulfill the state's compelling interest. If the state fails to prove these two burdens, with evidence, the regulation must give way to the individual's religious freedom. Missouri homeschoolers can now be certain that their religious rights will receive full protection under the law!
