Kansas--County Attorney Pursues Homeschool Family

Because of a report that their children were not in school, a Kansas
homeschool family is now under the scrutiny of a prosecutor.

On April 27, 2003, Sumner County Deputy County Attorney Evan C.
Watson asked a member family for proof the parents were "competent
instructors". He asked for their "instructor credentials and work
histories." He said he intended "only to ensure that [your child] is
obtaining his education as the law requires."

The question here is not simply whether this particular family is
homeschooling legally, but whether ANY Kansas family must submit to
investigation when the local County Attorney has no evidence they are
violating any law. We believe the answer is "no."

Because of this, we will advise the family to refuse to submit to the
County Attorney's demands unless he shows us he has evidence
("probable cause") that the family has violated the law. To do
otherwise could encourage other county attorneys to subject law
abiding homeschool families to investigation on flimsy pretenses.

On May 13, 2003, we wrote Watson asking what evidence he possess of a
violation of the law. We are awaiting his reply. Please pray for a
favorable outcome.
