Dear HSLDA Members and Friends,
Your calls have made a difference! The offending anti-parental rights language in the grandparent's bill has been removed largely due to your efforts.
This earlier this year, we sent out an alert concerning Senate Bill 128, which would allow grandparents and great-grandparents to sue parents for visitation rights.
Over the years, Home School Legal Defense Association has represented many families in conflict with grandparents who did not like homeschooling. These grandparents would try to stop the homeschooling through various means including turning the family over to the child welfare services. Thankfully, most grandparents we come in contact with at HSLDA support homeschooling and in some situations participate in the teaching.
Our concern was with the language in S.B. 128 that stated that grandparents could sue "natural parents who are still married to each other" if "either or both parents have used their parental authority to prohibit a relationship between the minor and the grandparents or great-grandparents."
As a result of the opposition from homeschoolers, the Senate Judiciary has approved a committee substitution for S.B. 128 which removes the language that would allow grandparents to sue for visitation when married parents choose to prohibit an unhealthy relationship.
This bill died last year due to homeschooler opposition to that same offending language. It seems that the legislature has listened to your calls!
