Missouri--Court Decision Changes Home School Law

Dear HSLDA Members and Friends,

The July 1-June 30 school year, to which we were all accustomed, no
longer automatically applies to home schoolers.

Because of a recent Eastern District Missouri Court of Appeals
decision, home school families must decide for themselves the dates
their home school term begins and ends. It cannot be longer than
twelve months.

Parents should provide the 1,000 required hours of instruction within
the dates they establish for their term. The required records should
be kept in a manner consistent with the dates of their school term.
The phrase "school year" no longer has any legal significance in the
home school context.

Parents need to keep records and offer 1,000 hours only if a child is
at least 7 years of age on the date the family's home school term
begins. Parents do not need to keep records or offer 1000 hours if
the child has not turned 7 by the first day of the family's term.

There are three court of appeals districts in Missouri: western,
southern, and eastern. A decision in one district is considered
authoritative in all districts unless another district has ruled
differently on the issue. Neither the western nor southern districts
have ruled on this issue to date, so this decision of the eastern
district court of appeals is considered authoritative across the
