Kansas Prosecutor Stirs Up Trouble Again
A Home School Legal Defense Association member family in Argonia recently received a letter from Sumner Deputy County Attorney Lee J. Davidson, saying that his office had "received a report" that their children might not be attending school. The letter instructed that, if they were "home schooling," they must complete certain paperwork and return it to him within 10 days.
When the family called HSLDA, we advised them not to fill out the questionnaires because they are not technically "home schooling" under Kansas state law. In the eyes of the law, the children are attending a properly registered "private school."
HSLDA explained all of this in a letter to attorney Davidson. Unfortunately, this is not the first time we've had to remind this county prosecutor of the law. In 1999, Davidson tried the same tactics against another member family. When the family refused, on our advice, to fill out the onerous and unauthorized questionnaire, a "Child in Need of Care" petition was promptly filed. HSLDA defended the family, the parents were vindicated, and the case was dismissed in short order.
In Kansas, when it is necessary for parents to discuss their children's education with school authorities, HSLDA strongly recommends that our members only refer to the fact that their children are attending private school. "Home schooling," by that name, is not legally recognized in Kansas.
