Congressman Tancredo, how can we stop judges from legislating from the bench?
Congressman Tancredo:
We’ve go to appoint the right ones, that’s all. Most of these things we’re talking about come from the top down. They come from the President of the United States. Some judges can be removed, but usually not for those kinds of reasons because they are not using their discretion in a manner—their judicial discretion—in a manner with which we agree. That’s probably not a way in which, I mean, not a reason for impeachment. But the appointment process is, of course, the one and the most important in terms of constraining the judiciary.
