Today on Home School Heartbeat, Mike Smith talks about one case HSLDA is working on that may impact homeschoolers across the country. Mike: HSLDA's litigation attorney Jim Mason joins me today to talk about one family from North Carolina HSLDA has been helping. Jim, as we mentioned yesterday the Stumbo family has had some difficulty with the state social workers. Is this an isolated incident, or has this been a problem in other states as well? Jim: Mike, this is a problem in all 50 states. HSLDA's attorneys deal with a situation like this almost on a daily basis. Social workers, when they receive an allegation of abuse or neglect, are trained to come out to the house and without regard to the constitutional rights of families to try to come into the home and inspect the interior of the house and to interview the children outside of the presence of the parents. And it doesn't matter to the social worker whether the allegations are serious or well founded, or based on anonymous tips or even if the social worker arrives on the scene and can determine as in the Stumbo case that all is well, there's no problems with the children, that everyone's fine. They still feel an obligation to go ahead and search the home and interview the children outside the presence of the parents.
