Though home schooling is legal in all fifty states, are there still laws that could jeopardize your home school? Michael Farris discusses this issue on today's Home School Heartbeat. Michael Farris: HSLDA is currently working on a case resulting from a Georgia law, which I believe is one of the most dangerous I've seen in my career. It's Georgia Statute Code Section 15-11-38, which allows "that a petition alleging delinquency, deprivation, or unruliness of a child may be made by any person, including a law enforcement officer, who has knowledge of the facts alleged or is informed and believes they're true." In other words, any individual who thinks your children are deprived or unruly because they're being home schooled, could file a petition against you! If the court or agent of the court believes that the petition is in the best interest of the child, you could be subpoenaed to appear in court to justify your home schooling. By law, your child would also be required to appear. If you fail to discredit the petition, the State could then move to direct the education of your child. A lengthy court case to regain your right to home school could ensue. If this law is expanded or promoted by opponents of home schooling, it could seriously impede the right to home school that HSLDA and so many others have worked so hard to protect. I'm Mike Farris.
