No response to Notice of Intent

Every year, some home educators in New York are faced with uncertainty about what to do when they receive no response from the school district to their notice of intent to instruct their children at home. According to the state commissioner of education's regulations, § 100.10 (c), the district is supposed to send the parents a copy of this regulation and a form on which to submit an Individualized Home Instruction Plan (IHIP) within 10 business days of receipt of the notice of intent. Parents then have four weeks from receipt of these materials or by August 15, whichever is later, to submit the completed IHIP form to the district. Thereafter, quarterly reports are submitted to the district on dates specified by the parent, and an annual assessment of the child's academic progress is included with the fourth quarterly report.

Since the time for submitting the completed IHIP form does not begin to run until the school district furnishes the form to the parents, it is Home School Legal Defense Association's opinion that parents who do not receive the form do not have to submit anything further to the school district. We recommend, however, that parents prepare the quarterly reports and annual assessment which may need to be submitted at a later time should the school district eventually provide the IHIP form to them for completion. — Dewitt T.
