Raleigh County Misses the Mark
    A Home School Legal Defense Association mother recently received a letter from Raleigh County Schools recommending that she initiate a remedial program for her child because of low test scores. Upon closer analysis, the child had scored at the 28th percentile on one subtest, but at or above the 60th percentile on all others. West Virginia Statute § 18-28-3(d) requires a remedial program only if the “composite test results” are not above the 40th percentile. The statute does not require remediation simply because the score on one specific subtest falls below the 40th percentile.
    Since this child’s composite score is well above the 40th percentile, the school board has been notified that no remediation is necessary.
