Expansion of Immunization Requirements Sought
    Senate Bill 1091, introduced by Senator William Purcell (D-17), would require every child born before July 1, 1994, and not yet immunized against hepatitis B to receive that vaccination before enrolling in the sixth grade. Current law requires all persons born after July 1, 1994, to be immunized against hepatitis B.
    State law governing home schools in North Carolina states that they are subject to the “requirements of law respecting immunization.” Thus, any expansion in the law for immunization against hepatitis B would apply to students in a home school.
    There are two exceptions to the requirement that students receive the immunizations:

(1) if a doctor certifies that a required immunization is or may be detrimental to a personís health, or

(2) if the parent of the child submits a written statement of bona fide religious beliefs in opposition to the immunization requirements.

    No child shall be exempt from immunization requirements simply because of a personal belief or philosophy of a parent or guardian not founded upon a religious belief. No legislative action has been taken on this bill since it was introduced on April 15, 1999.
