School Employees Still Have Rights
The following policy was submitted for the approval of the Engadine Consolidated School District: “School employees’ children should be in public school not home schooled.” Fortunately, the school board wisely rejected this proposed policy. It is a reminder, however, of the bias that is sometimes found at the highest levels of public school systems.
The right to educate one’s children at home is guaranteed by the U.S. Constitution. Any person who is refused employment, demoted, fired, or otherwise disadvantaged by a public school system on account of that person’s decision to educate his children at home may have a right to bring a legal action. This applies to the growing number of public school janitors, school bus drivers, teachers, principals, and school board members choosing to educate their children at home. Home School Legal Defense Association believes that every parent should have the right to home school. If you hear of any case where a person’s employment status is adversely affected because of his or her decision to educate children at home, please contact our office.
